The director of operations of a Subway franchisee, in West Virginia, sent letters to several churches and congregations saying his company was “in need of Christian employees.” I’m sure some people will not see the problem with such a letter, after all a business should be able to make hiring decisions that prefer a particular group of people. Some may think the guy was just trying to reach out to a segment of people to recruit more workers. The problem is that such outreach is actually against state and federal law.

The major conflict in human rights is to balance the rights of all people. You can do whatever you want with your life as long as that action doesn’t hurt others (physically or mentally) and conforms with restrictions from current laws. The basic precept is your rights stop at your neighbors door step. In church and state issues the challenge is to balance religious freedom with the rights set in the US Bill of Rights. In the case of a veteran teacher fired from a Catholic school because it became public she had a same-sex spouse, how far does religious liberty extend.

The fragile wall between church & state

Back in July I posted about a discrimination case involving a fired teacher at a church school in Redford Township, Michigan. She was fired after a long medical leave. The case was heard by the US Supreme Court on Wednesday October 5th. Instead of trying to argue under the religious clauses of the 1st amendment, the government is using an argument under the freedom of association clause. That choice seemed to shock the justices. I think it is brilliant – if it works.

The fragile wall between church & state

Some churches and religious groups complain about separation of church and state when they want to force their views into the public sphere like schools and government. However when these groups want to discriminate they become the biggest fans of the wall between church and state. They shouldn’t have it both ways.

A teacher at a church school in Redford Township, Michigan was fired when the school board wouldn’t allow her to return to work after a long medical leave.
