The US Supreme Court ruled today that college groups can’t discriminate in its membership if the college has a non-discrimination policy. The Christian Legal Society, which excluded gays from membership, sued a law school after it refused to give it official campus funding and recognition.

Secular Coalition for America released a statement today opposing the nomination of Elena Kagan to the US Supreme Court. It says her previous legal views give concern that she may not strongly defend church state separation as the Justice she is suppose to replace. Their reasons are sound.

Last week the US Supreme Court ruled that a transfer of land, holding a cross erected in the Mojave National Preserve in California then sold to a private group after a lower court ruled that the cross violated the 1st amendment, needed to be reassessed in light of their holding that a Latin cross is a generic symbol of war dead. The ruling opens a can of worms that neither believers or non-believers might enjoy.

On Wednesday, February 25th, the US Supreme Court issued a ruling on a Utah monument case that involved the city of Pleasant Grove and religious group which tried to donate a monument to their Seven Aphorisms to be placed near an existing one with the Christian 10 Commandments. Unlike most cases like this, it was considered on Free Speech grounds rather than on religious establishment grounds. The court ruled that a government can pick and choose what gifts to receive and in doing so seemed to open them up to establishment challenges in the future.

The first court challenge to President Bush’s Office of Faith-Based and Community Initiatives ended on a technicality according to the US Supreme Court. It said that since the funding wasn’t from Congress then the public have no standing to challenge it.
